The Holbrook man accused of driving drunk and fatally striking a Boy Scout was in court Monday.
Thomas Murphy's court conference was held in Central Islip.
Alyssa McMorris, the mother of 12-year-old Boy Scout Andrew McMorris, gave a statement as she left the courtroom.
"Something that's unimaginable has been made a lot worse. And right now, this week, I'm focusing on the anniversary of my baby's entrance into heaven," said McMorris.
McMorris, along with family and friends, sat in the courtroom wearing the Boy Scout red and small pins with her son's picture.
Supreme Court Justice Fernando Camacho denied several motions requested by Murphy's new attorney.
Murphy is charged with vehicular homicide after his 2016 Mercedes struck 12-year-old Andrew McMorris, who was hiking with a group of Boy Scouts on Sept. 30, 2018.
Prosecutors claim Murphy was driving drunk. His trial is set for Oct. 8.
